The Constitution of The New Roman Empire of Bax-Landia

We the Government and People of Bax Landia, in order to establish a more perfect Empire, establish Justice, insure domestic tranquility, promote the general welfare, and secure liberty and prosperity to ourselves, do establish and ordain this constitution of The New Roman Empire of Bax-Landia

Article 1 The Imperial Family

Section 1 The Emperor

The Head of the Imperial Family shall be adorned as the chief executive of the Empire, and be given the title of Emperor of Bax-Landia, and shall serve a term as long as he/she chooses

Section 2 New Emperor

Upon the Emperor's Death the new Emperor, so long as he/she did not murder the former Emperor, shall be the eldest child of the recently deceased Emperor. If the Emperor does not have any living children it shall go to the Emperor's eldest living relative, including his/her spouse
If the serving Emperor chooses to retire before death He/She may choose their successor regardless of the eldest child rule.

Section 3 State of the Empire

On the equinox's, The Emperor shall address the People and Legislator about the current status of Bax-Landia and the Empire's future plans

Section 4 Imperial Family military powers

The Emperor Is the Head of Military of Bax-Landia, and of the People if called upon by the Legislator to serve the Empire
The Emperor has the power to build and expand the military with the budget given by Legislative
The power to promote or demote officers and name new officers shall be held by the Emperor
The Emperor has the power to use Bax-Landian military forces for up to 100 days with 40 days extended to withdraw forces with no explanation to the legislator or legislative declaration of war
The Emperor has the power to make rules on the capture of land and sea

Section 5 Imperial Family domestic powers

The Region of Nova Roma, in which the capital resides in, shall be governed by the Emperor as the Region's Lord, he shall still be referred to as Emperor
The Emperor shall have the power to grant reprieves and pardons for cases against Bax-Landia and the province of Nova Roma
The Emperor shall be able to fill vacancies in the legislator if there is one to occur, and that appointment shall serve until the next election cycle
The Emperor can, if he/she chooses, introduce bills into the legislative branch for them to vote upon
The Emperor has the power to convene the Legislator, if they are out of session, and hold them in session if need be
The Emperor with the advice and consent of The Upper Branch of The Legislator shall appoint or confirm ambassadors, federal attorneys, Judges to all Empirical courts, and heads of departments
The Emperor has the power to coin money and regulate the value thereof

Section 6 Imperial Family Foreign Power

The Emperor with the advice and consent of The Upper Branch of The Legislator shall make and form treaties with other recognized countries, nations, or states

Section 7 New Imperial family

If the current imperial family is to all die out with no living descendants from the original Emperors, Emperor Julius Caesar and his successor Emperor Augustus Caesar, a new imperial family shall be elected from the Lords of the different Regions of the Empire
Until a new family is elected or appointed the Empire shall be under martial law with the two legislative houses being the head of military
The two families, with the most votes after a primary election held on the first of the next month, shall be up for election again on the 15th of that same month with the winner's head of family becoming the new Emperor
this shall be avoided at almost any cost as it would likely cause chaos and war

Article 2 The Legislative

Section 1 the Legislative

The Power to make laws and regulations shall be vested in the Legislative of The New Roman Empire of Bax-Landia, which shall consist of two houses, an Upper and Lower house.

Section 2 the lower house

The Lower house shall be elected every 2 years, by the People of the several Regions, with each delegate receiving one vote
No person below the age of 20 and a citizen, since birth, of the Empire shall be able to serve in the lower house
The lower house's representation shall be proportional to the population of the Region
The delegates going to the lower house shall be represented by the proportion of votes the party gets(i.e. A Region has ten delegates if a party is to win 10% of the vote they get to send the delegate with the most votes)
If a vacancy is to occur refer to article 1 section 5 line 3
The Lower house has the power to chose the head of the lower house and their officers
The Lower house has the power to impeach any appointed and confirmed official but does not have the power to impeach the Emperor

Section 3 The Upper House

Every Region shall have three Uppers
Each upper shall serve a term of 6 years with one upper from every Region getting elected every 2 years
No person shall be an upper who shall not have reached 30 years of age and a citizen since birth
The Upper house has the power to chose the head of the upper house and their officers
The upper house has the power to try all impeachments while impeachment cases are being tried the chief justice of the Highest court shall preside
Judgment in impeachment cases shall extend no further than removal from office and disqualification to hold any other appointed office but the party convicted shall nevertheless be subject and liable to indictment, trial and punishment, as the law permits

Section 4 Internal Powers

Each house may determine its rules and proceedings, punish a member for disorderly conduct, and with the concurrence of two-thirds expel a member in which case the vacancy shall be referred to article 1 section 5 line 3
Each house shall keep a journal of its proceeding and release said journals from time to time so long as there is no matter requiring secrecy, and the yeas and nays of each vote shall be recorded into the journal when and if there is a vote on a question
Each delegate from upper and lower house shall receive a payment for their services paid by the treasure of Bax-Landia
Each delegate shall be free from arrest when in session except for crimes of treason, felony, and breaching of peace
No delegate shall hold any other government office other than the one he/she has been elected to
If the pay of delegates shall go up the new pay shall not be in effect until the next legislative is chosen

Section 5 Powers of the legislative

Bills of revenue shall originate in the lower house but the upper house can propose or concur as on any other bill
The Legislative shall have the power to lay and collect taxes, to pay for the common defense and general welfare of Bax-Landia and all taxes shall be uniform throughout Bax-Landia
To borrow money on the credit of Bax-Landia
To regulate commerce between foreign nations and ensure free trade between the many Regions
To establish a uniform law of naturalization and bankruptcy throughout the Empire
To provide punishment for counterfeiting the current and former coin of the Empire
To establish post offices and postal roads
To promote the sciences by granting them the rights to their findings, discoveries, and writings
To create courts inferior to the highest court
To define and punish piracies and felonies within the Empire's domain
To Declare War, grant letters of marque and reprisal
To Provide a military budget of which shall be no smaller than 30% of the nation's budget
To provide for calling upon the People to execute the laws of the Empire, suppress insurrections, and repel invasions
To make all laws necessary and proper for carrying out these duties

Section 6 forbidden powers to the legislative

The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion when the public's safety may require it
No Bill of attainder nor ex-post-facto law shall be passed
No tax shall be laid on any export from any Region
No Preference shall be given by any Regulation of Commerce to the Ports of one Region over those of another nor shall Vessels bound to, or from, one Region, be obliged to enter, clear, or pay Duties in another

Section 7 Powers forbidden to the Regions

No Region shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex-post-facto Law, or Law impairing the Obligation of Contracts
No Region shall, without the consent of the legislator, impose any tax on imports except what may be necessary to enforce its inspection laws and the net Produce of all Taxes, laid by any Region on Imports or Exports, shall be for the Use of the Treasury of Bax-Landia
No Region shall form, keep or maintain a military except for the Region of the Emperor

Article 3 The Judiciary

Section 1

The Judicial power of The New Roman Empire of Bax-Landia shall be vested in the Highest court, and in such inferior courts as the Legislative may establish
The Judges, of both the highest and inferior courts, shall serve during periods of good behavior and receive payments for their services, such payments shall not be diminished while serving

Section 2 Judicial powers

The Judiciary has the power to determine reasonable punishment for crimes against The Empire
The Judiciary has the power of judicial review
The Highest Court at times of great turmoil and big decisions can call upon the Military and Praetorian Guard to protect and defend the Court and its justices, The Emperor does not have the right to refuse this request from the highest court

Article 4 Region relations

section 1 Citizenry
The citizens of each Region shall be entitled to the privileges and immunities of the citizens in the several Regions
A Person charged in any Region with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another Region, shall on Demand of the Lord/Lady of the Region from which he fled, be delivered up, to be removed to the Region having Jurisdiction of the Crime.

Section 2 new Regions

New Regions may be admitted by the legislative of the Empire
No new Region without the consent of the Regions legislatives shall be formed from any two or more current Regions
Each Region shall have a government similar to the of the one established by this constitution

Article 5 Amendments

The legislative whenever two-thirds of both houses or when two third of the legislatives of the Regions shall deem necessary shall propose amendments to this constitution and upon ratification, by three-fourths of the Regions the amendment shall be accepted and become apart of the constitution
No amendment shall affect the equal vote of the upper house

Article 6 prior Debts and national law

All prior national debts shall be held by the new government formed in this constitution
This Constitution is the supreme law of the land and no laws shall overrule it

Article 7 The rights of the People and Regions

The People Have the freedom of speech, assembly, and petition
The People, so long not convicted of a violent crime, shall have the right to keep and bear arms and no form of arms shall be infringed
The People have the right to refuse to house soldiers during times of peace in the land
The People have the right to not be searched without probable cause and no warrant shall be issued without it, and any evidence illegal collected against a person shall be inadmissible to the courts
No Person shall be subject for the same offense be twice put in jeopardy
In all criminal prosecutions, the People have the right to a fair and speedy trial by an impartial jury in the Region of which the crime was committed, to obtain an attorney, to view witness against him, to gather witnesses in his favor
The People have the right to privacy on private property(residence) and no private residencies of citizens shall be wiretapped without proper notification of the party accused
The Citizenry have the right to vote
The People have the right to try new and innovative medicines and medicinal practices
Anything that is not in this constitution nor prohibited by it is reserved to the Regions and People

Article 8

The Vote of two-thirds of all of the citizens shall be sufficient to Establish this constitution
This shall be the only mandatory election of the Citizenry
This vote shall be conducted on the first of November of the 87 year G.E.
