The Hiyamashū Constitution (The Founding Articles)
The Member States of The Empire of Hiyamashū: In order to instil peace, prosperity and security of nations in this august union, this constitution, in its entirety, establishes The Empire of Hiyamashū and ensure the progressiveness of all Member states.
§1 – General Provisions
§1.1: The Empire of Hiyamashū
The name of this region shall be The Empire of Hiyamashū.
For ease, it can be spelled as “Hiyamashuu” and the name can be shortened to Shūkoku.
The region shall not surrender to alien forces or merge and shall stay as sovereign.
§1.2: Aims
Hiyamashū shall protect all member states in the region at the best of its abilities.
It shall safeguard and protect the sovereignty of the region.
It shall promote the common goals of member states.
It shall ensure the greatest possible equality for justice between all states.
It shall be committed to peace and neutrality internationally.
§1.3: Member States
“Member states” are defined as “Residents” in NationStates.
All member states have an important part to play in the governance, law & order as well as achieving the goals and tasks of this region.
§2 – Instruments of Governance
§2.1: Democracy
The government shall act democratically, secularly and openly.
Members of the government shall actively contribute to the region’s best interest and not to use the office of government to their own personal means.
§2.2: Qualifications
Members of the government must hold the following qualities in order to hold office,
Nation must be a Member State.
Nation must be at least 28 days old.
Nation must be in Hiyamashū for at least 42 days.
Nation required to be active in NationStates; Online once every two days.
§3 – The Crown
§3.1: The Crown
The Crown is the Founder of the region and the Head-of-state.
They shall in charge of overseeing the democratic process in Hiyamashū.
§3.2: Authority
The Crown’s authority derives from being the founding nation of the region.
They may veto any law passed by parliament.
They retain the supreme authority of the region.
They may assign a member state as an assistant by merit, stated in §4.
§3.3: Appointment of Government Offices
The Crown shall appoint the First Minister as designated by vote.
They shall appoint the Members of First Council upon request by the First Minister.
The Crown shall retain full authority over the appointment of Government Offices and may dismiss any Officer.
§3.4: At His/Her Imperial Majesty’s Pleasure
This term can be applied to punishments, term limits or any duration-dependent issue.
This term implies that the duration shall last till The Crown finds it fit to end.
§4 – Office of The State Advisor
§4.1: The State Advisor
The State Advisor is the Assistant to The Crown.
They have no authority in the region other than to serve as an advisor to The Crown unless granted explicit permission by The Crown.
§5 – Office of the First Minister
§5.1: The First Minister
The First Minister is Head-of-government.
They shall be in charge of the daily management and running of government.
§5.2: Appointment
The most popular candidate during People's Council elections shall be appointed as First Minister
§5.3: Term Limits
The First Minister has can only serve for a maximum of 2 terms and cannot serve more 2 terms concurrently. Each term is 28 days.
§5.4: Authority
The First Minister is second in command from The Crown.
They may assign suitable member states to The First Council by merit.
They may veto any law passed by parliament. Veto may be overruled by a 2/3 vote by the parliament.
They shall have all permissions except for border control.
§5.5: Line of Succession
Shall be used when the First Minister,
dies in office,
unable to perform their duties or,
do not meet the necessary activity requirements.
Till the First Minister is able to perform their duties reliable, the following shall occur,
The Deputy First Minister shall assume the role of First Minister and shall not hold office for longer than 31 days.
During the span of said 31 days, if the First Minister is confirmed to be unable to serve Hiyamashū for the remainder of their term, an emergency election shall be held and the First Council shall be dissolved with immediate effect.
However, if a suitable candidate for First Minister cannot be found, the Office of The First Minister shall be merged with the WA Delegation Office till a suitable candidate has been found.
§6 – Office of the World Assembly Delegation
§6.1: World Assembly Delegate
The World Assembly Delegate is decided via the endorsement system of NationStates.
They are the representative of Hiyamashū in the World Assembly.
They are to vote for the best interest of the region and of the member states.
§6.2: Authority
The World Assembly Delegate is third in command from The Crown.
They shall have permissions to the World Assembly, Communications & Polls and do not have Executive rights.
§6.3: World Assembly Resolutions
The World Assembly Delegate shall vote according to what is desired by the majority in Hiyamashū and what is best for the region.
§7 – The First Council
§7.1: The First Council
The First Council is the cabinet of the First Minister and is a part of parliament.
It consists of 5 members
§7.2: Positions
The positions in the council are,
First Minister
Deputy First Minister,
Minister of Security,
Minister of International Affairs, and
Minister of Internal Affairs.
§7.3: Appointment of Members
All members shall be appointed by the First Minister.
§7.4: Term Limits
Upon the First Minister leaving office, all members of The First Council will vacate office.
§8 – The People’s Council
§8.1: The People’s Council
Parliament shall be lower house of and shall be the sole law-making organ of the region.
It should make laws in the interest of the region and to protect the sovereignty of the region.
It shall have 7 members.
§8.2: Appointment
Parliamentary Members shall be appointed by direct vote via elections.
§8.3: Term Limits
Parliamentary Members shall only serve for 20 days. There is no limit to number of terms.
§9 – Judiciary System
§9.1: Justice by referendums
All punishments and decisions of the convicted are to be made by the People’s Council. Passed by a ½ vote.
This excludes hostile entities and of those who committed treason unless overruled by The Crown.
§9.2: Exclusions
During a crisis and when swift action needs to be taken in order to resolve a severe issue, with the approval of the First Council, The IM shall have the ability to perform actions that do not require approval from any organs of government.
§10 – Neutrality & Diplomacy
§10.1: Neutral Stance
The region of The Empire of Hiyamashū is a neutral region and shall renounce war.
§10.2: International Affairs & Embassies
Embassy invitations should be accepted unless requesting region is an extremist region or a region that poses security risk to Hiyamashū.
All embassies are an important asset in diplomacy, embassies shall only be closed if embassy region poses a high security risk or is closed to being destroyed by raiders.
Should an embassy region be raided, The Empire of Hiyamashū shall not be involved in the affairs of said region and shall stay neutral.
§11 – Regional Symbol
§11.1: Regional Flag
The regional flag of The Empire of Hiyamashū consists of,
A sun representing the brightness and liveness of the region
A white background representing the purity of its members.
Three supporting base below the mountains to represent the 3 founding nations.
§12 – Emergency Powers
§12.1: Emergency Events
In an event of an emergency such as, but not limited to
Raiding
Civil/Internal unrest
Administration overthrow
Obstruction to Justice
Only applies to High Treason
Extremist overthrow.
§12.2: Powers
Under emergency powers, the First Minister, under the direction of the IM, is able to perform large changes that may adversely affect Hiyamashū as a whole. This includes,
Suspension of Liberties
Dismissal of all positions.
In order to trigger emergency powers, the First Minister, or his cabinet, is required to seek approval from the IM.
Emergency powers will apply for as long as the IM sees fit.
§13 – Extremism Prohibited
§13.1: Ideology
Extremist ideologies are defined as the following, but not limited to,
Fascism
Communism
Nazism
Any variant of the ideologies listed
§13.2: Limitation of rights
Nations with extremist ideologies are not recognised as member states and do not share the same rights as other nations.
Nations with extremist ideologies are not allowed to hold position(s) in Hiyamashū.
§14 – Democracy
§14.1: Impeachment
The First Minister, Members of the First Council, Members of the Legislative Parliament may be subjected to impeachment.
The IM may not be impeached.
The World Assembly Delegate may not be impeached by voting.
An impeachment request can be made by member states.
Impeachment can only occur to said state via a majority vote.
Once impeached, said state shall vacate office with immediate effect.
All impeachment requests shall be directed to the IM and evaluated accordingly.
§14.2: Elections & Referendums
All elections shall be decided via direct vote.
They shall be true, objective and fair.
All referendums may only last for a maximum 4 days and a minimum of 1 day.
The IM and World Assembly delegate may not vote.
If a referendum is tied, the IM and World Assembly delegate may, only then, place their vote.
Upon the ending of voting, the decision chosen by the majority shall be performed within 4 days from ending.
§14.4: First Council Internal Resolutions
A resolution shall last for 2 days.
A ½ vote is required for the passing of a bill.
Actions taken after the bill is passed internally:
The IM is required to approve the bill.
Public Referendum is required to fully passed the bill if the IM deems the decision controversial.
§14.5: First Minister Elections
First Minister elections shall be held 6 days before end of current holder’s term.
During an Emergency Election, the First Minister must be decided in 20 days starting from the day the Emergency Election is declared.

§15 – Amendment of Constitution
§15.1: Amendment

§16 – Legislation Process
§16.1: Proposal
A proposal must be proposed to The People’s Council.
The People’s Council shall be required to look over the proposal and make amendments if seen required.
A ⅔ vote is required to pass the proposal
If the proposal is approved, the proposal becomes a bill and it is sent to The First Council for approval.
If the proposal is rejected, the proposal is discarded.
§16.2: Bill
The First Council is required to review all bills given by The People’s Council.
A ⅔ vote is required to pass the bill
If the bill is approved, the bill is sent to The Crown for final approval
If the bill is rejected, the bill will be sent back to The People’s Council for amendment.
Accordance to §16.1
§16.3: Approval
The Crown shall review all bills from The People’s Council.
The Crown may reject bills, but is required to cite a reason.
All rejected bills are sent back to The People’s Council.
