Constitution of the Republic of Lavan Tiri

The Year of Our Lord 1824

The People of Lavan Tiri, being defined as the territories of Portugal, Spain, Morocco, Algeria, Tunisia, and Sicily

Dissatisfied with the system of nobility and feudalism which perpetuates misery and poverty within our great nation

Hereby dedicate ourselves to the cause of remaking our nation as a Republic, constructed by and for the Lavani people

Section One: Duties and Responsibilities of the Monarch

THE QUEEN, being recognized and appointed by God to lead our people, shall be allowed to retain her position.

THEREFORE, we the People, in respect of Queen Maria Coroa X's respect for us and the Republic,

RESOLVE THAT, while every other noble house shall be legally abolished and stripped of all power beyond that of a regular citizen, the House of Coroa and their direct heirs shall be allowed to maintain their residence in Imponerse, the Palacio de Prata.

IN ADDITION, the House of Coroa shall retain limited legal and political powers, described henceforth

Firstly, the Monarch (defined as the direct Heir of the previous Monarch, beginning with Maria X's Heir, Leonor Coroa III) shall retain the power to convene the sessions of Parliament, both regularly at the New Year and in times of emergency

Secondly, the Monarch shall retain the power to issue a pardon for any convicted criminal in the nation.

Thirdly, the Monarch shall retain the power to mobilize the Lavani military in times of national distress

Fourth, the Monarch shall retain the power to dismiss, appoint, and approve non-elected officers of government, such as Colonial Governors and the Presidential Secretaries.

ADDITIONALLY, the Monarch shall retain the following duties

Firstly, the Monarch shall be bound to always act in the interests of the nation at large. If the Parliament feels as though the actions of the Monarch have not been in the interests of the nation, a seventy per cent majority of the Parlamento Intiero can overturn these actions.

Secondly, the Monarch must call the Parlamento Intiero, as well as both Chambers, into session on January the Fifth of every year, and dismiss them on December the Twentieth of that year

Thirdly, the Monarch must meet with the newly elected Chancellor and President no later than January the Third in every year of the Chancellor and President's service to discuss the state of the nation and the formation of a Cabinet

Fourth, the Monarch must not use their power of pardon for the benefit of themself or any direct relation of theirs

Section Two: Duties and Responsibilities of the Legislature

ACKNOWLEDGING THAT we the people of Lavan Tiri have lacked any formal representation in the governance of the nation,

WE HEREBY ESTABLISH the Parliament of Lavan Tiri, to represent the people and their wishes

THE PARLIAMENT shall be hereby composed

The First Chamber, the House of Delegates, shall be composed of Three Delegates from every Province. Delegates must be a resident of their Province for at least ten years, and must be at least thirty years of age upon election. Delegates shall be elected every five years.

The Second Chamber, the National Assembly, shall be elected from a number of Districts, each representing no less than Three Hundred and Fifty Thousand people, and no more than Three Hundred and Eighty Thousand. Districts shall be drawn according to population every 7 years, by the Officer of the Census. The Officer of the Census shall be appointed by the People's Advocate with the advice of the Monarch, and approved by the Assembly. The Officer serves at the Pleasure of the Monarch.

The two Chambers have the following powers vested in them: to elect their own leadership, to set their own procedural rules, to pass legislation via a majority vote, to increase or decrease taxes, to deploy or recall the Military, to repeal legislation, and to overturn the veto powers of the President by a Two Thirds Vote

The Unique Duties of the House of Delegates are to elect a new Monarch upon the passing or abdication of the current Monarch, to originate legislation to raise or lower taxes, to certify the results of all nationwide elections, to approve of the addition or dissolution of Provinces, and to Impeach the President and other officials for for High Crimes against the Nation.

The Unique Duties of the National Assembly are to Advise the Monarch on the Appointment and Dismissal of the President's Cabinet, to authorize the promotion of Military Officers, and to Advise the Monarch to retain or eject an Impeached President

The Parliament Shall Be Governed by a Prime Minister, elected by a majority vote of Members of Parliament from their own ranks. The President shall preside over the legislative process, decidicunghich legislation to bring forth to each Chamber. The President presides over the Impeachment process of the Chancellor, and is a member of the Chancellor's Cabinet. The President presides over Parliamentary debate, and members may not speak without permission from the President. The President shall appoint two Vice Presidents, one of the Assembly and one of the House, to fulfill their duties when the President cannot. The President may not speak during floor debates and must cast their votes secretly.

Members of the House shall be elected for a term lasting Five Years

Members of the Assembly shall be elected for a term lasting Three Years

The President and Vice Presidents, when elected, shall serve at the Pleasure of the Parliament. A Two-Thirds Majority in either Chamber may call for a Confidence Election. A majority of Fifty Five Percent is required to eject a President or Vice President from power.

Section Three: Duties and Responsibilities of the Chancellor

The Chancellor of Lavan Tiri shall be elected by a Majority Vote of the Populace, conducted every six years. The Chancellor may serve as many terms as the people allow.

The Chancellor must be at least Thirty Years of Age, and a Citizen of Lavan Tiri for at least Twenty Years.

The Chancellor is responsible for Representing Lavan Tiri in matters of International Affairs, negotiating Foreign Commerce, maintaining the Royal Lands and Residence, and serving as Supreme Commander of all Armed Forces of Lavan Tiri.

The Chancellor must, by January the Third after being elected, form a Cabinet consisting of the following officers: Secretary of Defense, Secretary of International Affairs, Secretary of International Commerce, and Secretary of Heritage.

The Chancellor's Cabinet must be approved by the Monarch, with the advice and consent of Parliament. The Monarch can also, in turn, dismiss a Secretary. Additionally, the Parliament, by a majority vote in both Chambers, can force the Monarch to consider dismissal of a Secretary.

The Chancellor can be Impeached by a Two-Thirds majority of Delegates. A Chancellor can be impeached for High Crimes, Misdemeanors, Treason, and Felonious Behavior. Once Impeached, the Chancellor is put on trial by the Assembly. A Three Fifths Majority of the Assembly must agree to Eject the Chancellor. An Ejected Chancellor is barred from ever holding public office in Lavan Tiri again and will be tried for crimes committed in front of the High Court.

Duties and Responsibilities of the People's Advocate and the Courts

The People's Advocate shall serve as the highest officer of Law Enforcement in the Republic. They shall be elected nationwide every seven years, and may only serve three terms.

The People's Advocate is responsible for the administration of the Census, all elections except their own, law enforcement and policing, representing the People in cases against the Nation, and representing the Nation in all other cases.

The High Court shall be the Court of Last Resort, appealed to after Provincial Courts. There shall be Five Magistrates on the High Court, who each serve a term of Six Years, with no more than three terms. One shall be appointed by the Chancellor, one by the Monarch, and the other three shall be elected nationwide.

The Rights and Duties of the People of Lavan Tiri

The People have the unalienable, unquestionable Rights to Speak Freely, Publish Freely, Worship Freely, Petition the Government, Assemble Peaceable, Bear Arms, Engage in Commerce National and International, Travel Freely, and use Royal Lands

The People have the sacred and binding responsibilities to Vote, Overthrow a Tyrannical Government, and Obey the Edicts of a Fair Government.

In the Eyes of God, the Queen, and the Nation, we the undersigned do hereby set our hands to this Constitution, this day, April 28th, the year of our Lord 1824.
