Constitution of the People's Unified Federation

Article One: Declaration as the Supreme Law

The signatories of their respective nations do embrace this constitution as the supreme law of the land, and agree to abide by the regulations and agreements made within.

Article Two: Declaration of The Legislative

1) In order to maintain a Unified government, the People's Unified Federation shall have a legislature for the purpose of creating laws, approving international treaties, and ensures all citizens have representation in Federal government. The Legislative branch shall be made up of two houses, Senate and Parliament.

2) Parliament shall be given the power to create new laws that apply to the People's Unified Federation, and oversee the other branches of government. Parliament may veto decisions by the President of the Federation, and/or the Heads of State Council, by a passing vote of two thirds members. Parliament may also veto Senate decisions by two thirds vote, except in cases of declaration of War, Acceptance of new Member Nations, international treaties, and overturning vetoes of Parliament. If the Heads of State Council is required to appoint a new President of the Federation, Parliament may also veto their selection with a two thirds vote. Any proposed government department or agency, created to benefit the Federation, must be ratified by Parliament by a two thirds vote.

3)Parliament shall be made up of 300 seats, split proportionally and based on population. These seats shall be divided between the member nations, and any applicable federally owned territories, such as colonial holdings. In the event a seat cannot be split evenly, the seat is given to the member with the smaller population. For a federally owned territory to apply for membership in Parliament, it must have a functioning localized government, population greater than 2 million, or 1/300th of the Federal Population, and 60% of the eligible population must have Federal citizenship.

4)Members of Parliament must be at least 35 years old, Federal citizens and reside in the territory they represent. Parliamentarians will serve in six year terms, with no maximum of terms of service. Parliamentarians may choose to abstain in a vote, in doing so their seat shall not be counted when determining if a vote passes. However, a Parliamentarian may not abstain in votes regarding vetoes, appointments of elected offices, or approval of new departments or agencies.

5) In order to facilitate order, Parliament will elect one member to the Position of Speaker of the People, by majority vote.

Senate

6) Senate shall be given the power to declare the following with a two thirds vote: State of War, Accept new Member Nations into the Federation, propose or approve international treaties, and vote 'No Confidence' in the current President of the Federation. Senate has the power to veto decisions by Parliament, by a two thirds vote, except in the case of Presidential succession, the ratification of new government departments or agencies, or vetoes issued by Parliament regarding Senate decisions. Any law ratified by Parliament with a two thirds vote must be ratified by the Senate with a simple majority vote. Senate has the power to veto decisions by the President or Heads of State Council, by a two thirds vote.

7) The Senate shall give 25 seats to each member nation, and 10 any applicable federally owned territories, such as colonial holdings. For a federally owned territory to apply for membership in Parliament, it must have a functioning localized government, population greater than 2 million, or 1/300th of the Federal Population, and 60% of the eligible population must have Federal citizenship.

In the event the Senate ever reaches 300 seats, the number of seats can be recalculated, as long as each member nation holds five seats for every two seats granted to each federally applicable territory.

8) Members of Senate must be at least 35 years old, Federal citizens, and reside in the territory they represent. Senators will serve in four year terms, with a maximum of four terms of service consecutively. Senators may choose to abstain in a vote regarding vetoes, and in doing so their seat shall not be counted when determining if a vote passes.

9) In order to facilitate order, Senate will elect one member to the Position of Presiding Senator, by majority vote.

Article Three: Declaration of the Executive

1) In order to maintain a Unified government, the People's Unified Federation shall have an Executive office, acting as central leadership, for the purpose of acting as a foreign delegate on behalf of the People's Unified Federation, providing leadership for governing agencies, and maintaining a central governing body in times of distress. The Executive Office shall be split into two branches, the Presidency, and the Heads of States Council.

2) The Office of the Presidency shall be given the power to appoint ministers over governmental departments and agencies, propose new governmental departments and agencies for Parliamentary approval, negotiate on behalf of the People's Unified Federation for international treaties, and send those treaties to be approved by the Senate, issue executive orders in times of distress, and act as the Generalissimo Supremo of the Federal Armed Forces.

3)The President shall maintain a Federal Security Council, made up of the Ministers leading key economic, infrastructure, intelligence, and foreign relations departments or agencies. This Security Council shall also include the highest ranking officer of each branch of the military. The duties of the Federal Security Council shall be to maintain the peace and prosperity of the Federation by coordinating the defense of military, economic, and foreign relation interests.

5) The Heads of State Council shall be made up of the Heads of States of every member nation in the People's Unified Federation, with one seat per member nation. In addition, one seat will be granted to the Speaker of the People, and one to the Presiding Senator.

6) The Heads of State Council shall be given the powers to Veto, by simple majority vote, executive orders issued by, and foreign treaties proposed by, the President of the Federation, and any laws ratified by Parliament. In doing so, the Heads of State Council may choose to make amendments or modifications to proposals, rather than rejecting them, before sending them to the Senate for Approval. If the Heads of State Council vetoes a law proposed by Parliament, the Senate can override such veto with two thirds vote.

If the Senate votes No Confidence in an elected President of the Federation, the Heads of State Council will vote to ratify it by simple majority vote. If ratified, the Heads of State Council will elect an acting President of the Federation from among their members by marjory vote until another election can occur.

Article Four: Declaration of the Judicial

1) In order to maintain a fair and uniform enforcement of the laws imposed by the People's Unified Federation, a Court Supremo shall be established as the supreme judicial authority of Federal Law.

2) The Court Supremo shall be given the power to ensure all laws made by either Federal authority or member nations, all treaties ratified, and all agencies and departments established by Federal Authority abide by this constitution, the rights established there in, and existing Federal Law. The Court Supremo shall also be given the power to settle disagreements between member nations, determine the outcome of trials, and punishments, for crimes against the Federation.

3)The Court Supremo shall be made up of no less than three appointed members from each member nation. These appointed members shall be known as a Justice Supremo.

4) While the Court Supremo shall have the final determination in rulings, a lower court known as the Court Mayor shall be established in the Capital Cities of every member nation. The Court Mayor shall have at least one appointed Justice Mayor from every member nation and handle cases that arise in that member nation. The member nation may appeal the ruling to the Court Supremo if they so choose.

5)The Court Supremo may, as needs arise, establish Court Minors in any Federal territory, to be made up of Justice Minors. The Court Supremo may also grant the Court Mayors the ability to establish Court Minors as needed.

Court Decisions
6) Decisions at all levels must be decided by marjory vote. Whoever is subject to a ruling by a Court Minor may appeal that decision to the local Court Mayor, or the Court Supremo if there is no applicable local Court Mayor.

7) Justices at all levels must be at least 30 years old, and Federal citizens. Justice Supremos, and Justice Mayors, shall be appointed by the governments of member nations. Justice Minors shall be appointed by the local governance in which their court resides, either by the local government of the court's member nation, or local government of the applicable federally owned territories. All Justices, regardless of level, shall serve in six year terms, with no maximum terms of service.

Article Five: Declaration of Rights and Responsibilities regarding Member Nations

Establish a democratic Federation
1) Member nations have the duty to ensure appointments to Federal offices, such as their assigned seats in Parliament, Senate, and Justice, are made by citizens of the Federation, either through local elections, or other democratic methods.

2) Member nations will yield their international relations, armed forces, production of currency, and regulation of commerce to the People's Unified Federation. Each member nation will honor the rights of The People established in article Six.

3) The People's Unified Federation will not dictate requirements regarding the methods of governance of its member nations. Member nations may determine their own citizenship requirements, but citizenship in a member nation will not grant citizenship in the People's Unified Federation. Citizenship in the People's Unified Federation is covered by Article Six. Although member nations yield their armed forces to the Federation, the People's Unified Federation will grant each member nation a Reserve Guard, for domestic security and to maintain the peace, to serve under the member's Head of State. In addition, member nations may aid and supply local miltias, provided those militias are under leadership of Federal Citizens.

New Member Nations(Mejico clause)
4) Whether through voluntary unification or dissolution of a member nation, new nations who wish to join the People's Unified Federation must be approved by the Senate with a two thirds vote. If a member nation dissolves into new nationstates, or a new nation is created in the territory of a member nation, the senators from the original member nation are barred from voting on the memberships of the new nations, and shall not be counted as part of this vote.

5) If desired, Member nations may vote to dissolve their relationship with the People's Unified Federation. This shall be performed by a public vote by The People of the member nation. A vote shall only pass if two thirds majority of The People vote in favor. This vote to leave the Federation may only occur once every 20 years, or not before the 20th anniversary of the previous vote.

Article Six: Declaration of rights and responsibilities regarding The People

Establishment of The People
1) There shall be two levels of individual membership in the People's Unified Federation, denizens and Citizens. Collectively, they shall be referred to as The People.

Establishment of Denizens
2) The following rights and responsibilities shall apply to citizens of any member nation, or any sentient being permanently residing in territory belonging to the People's Unified Federation, unless a foreign national. These individuals shall be referred to as Denizens of The People's Unified Federation. Foreign nationals may apply for Denizenship provided they permanently reside in, or are a refugee brought to, territory belonging to the People's Unified Federation, marry a citizen or denizen, or other qualifications granted by the Senate.

Rights of Denizens
3) Denizens shall have the following rights:
The right of peaceful assembly
The right to petition local and Federal government with a list of grievance
The right of the press to address concerns
The right to practice religion unmolested
The right to life, liberty and pursuit of property, and to not be denied life, liberty or property without fair legal proceedings.
The right to petition for a legal dispute to be heard by a local Federal Court, to ensure compliance with Federal Law.
The right to possess arms for personal and common defense, or to serve in a militia.
The Right to refuse the responsibilities of Federal citizenship, and remain a denizen of the People's Unified Federation. In doing so, retaining these rights, and any others not limited by Federal, national, or local law.

Responsiblities of Denizens
4) Denizens shall have the following responsibilities:
Pay taxes at an appropriate rate to support the common defense, federal programs, and general warfare of the People's Unified Federation.
Abide by and adhere to Federal law applying to Denizens of the People's Unified Federation.
Answer the call of compulsory Federal Service if required. In the event of compulsory federal service, Federal citizenship shall be granted upon completion of training, unless revoked during federal service as part of a legal or military punishment.

5) Citizenship in the People's Unified Federation shall be granted upon completion of one of the following acts:
Four years of public service to a Federal purpose, either compulsory military service or other service approved by the Federal government.
Being a citizen of a member state on the day the member state is accepted into the People's Unified Federation.
Citizenship approved by Federal Senate
In accepting Federal citizenship, citizens have these rights and responsibilities:

6) In addition to all rights granted to all denizens of the People's Unified Federation, Citizens may also have:
The Right to vote in Federal elections for Senate, Parliament, Justice, President of the Federation, and any other Federal offices granted to federally applicable territory.
If a Citizen resides in a federally applicable territory, the right to vote for representation in the local government.
The Right to run for Federal offices, provided all other requirements are met, including local government in federally applicable territory.
The Right to join, organize, or command a militia in times of peace, so as to be ready in times of war.
The Right to travel freely as a citizen of the Federation.
The right to benefit from Federal programs, including federally funded healthcare and education programs, or other Federally funded programs as applicable.

Responsibilities of Citizens
7) Federal Citizens shall pay taxes at an appropriate rate to support the common defense, federal programs, and general warfare of the People's Unified Federation.
Abide by and adhere to Federal law applying to citizens of the People's Unified Federation.
Answer the call of additional compulsory Federal Service if required.

Article Seven: Declaration of modifications to this Constitution

1) Amending this Constitution may be proposed by Parliament, Senate, President of the Federation, or the Heads of State Council. Amendments must be ratified by both Parliament and Senate by a two thirds vote, and the Heads of State Council by majority vote. Amendments shall be included in this Article of the Constitution.

Amendment 1, Agreement of Unification Treaties
2) In the event a free independent nation wishes to join the People's Unified Federation, it may enter negotiations with the People's Unified Federation to change how Article five may apply. This treaty shall fall to the Senate to ratify, as with any other international treaty.

Amendment 2, Heads of State as Generalissimo Supremo
3a) In times of Distress, any Head of State of any member nation may assume control of all Federal assets within their borders if the following conditions are met: A state of Distress has been declared. Communication with the Federal government, including the President of the Federation, is not possible.

3b) In the event a coup has occurred against the Federal government, a Head of State may declare themselves the Generalissimo Supremo of their member nation, rallying Federal and local assets within their borders to the defense of the People's Unified Federation.

3c) To prevent abuse and to restore Federal authority. The Heads of State Council, Parliament, Senate, or Court Supremo, may vote to restore assets to Federal control, by simple majority. The President of the Federation may order to restore Federal assets to Federal control without a vote.
