Brief Purpose: A bill which defines classified information that which the government deems sensitive enough to regional security.
Con Act., Confidentiality Act
Preamble:
ACKNOWLEDGING: the importance of keeping some information confidential, which might jeopardize the security of the region
UNDERSTANDING: that there is no current law regarding the confidentiality of the government.
This piece of legislation hereby establishes the following:
The government may withhold information from the public which may jeopardize the security of the region.
Individuals with security clearance may not share the classified information with other people that don't have the clearance to view such information.
If any individual with a security clearance discloses a confidential information, it will be treated as an act of treason and will face a trial at the supreme court.
Section I: Levels of Confidentiality
Sets three levels of Confidentiality. The First level blue being "Confidential", the Second level red being " Top Secret" and the Third level black "State Secret"
Level blue "Confidential" applied to information, the unauthorized disclosure of which reasonably could be expected to cause possible damage to the regional security. The Security clearance for level blue is members of the Regional Government and Discord Admins.
Level Red "Top Secret" applied to information, the unauthorized disclosure of which reasonably could be expected to cause serious damage to regional security. The Security clearance for level red is the President, Vice President, Speaker, Chief Justice, discord admins and Cabinet member the information applies to.
Level Black "State Security" applied to information, the unauthorized disclosure of which reasonably could be expected to cause extreme damage to regional security. The Security clearance for level black is the President, Founder, members given clearance to only by the president and founder and discord admins the information applies to.
Section II: Executive Privilege
Allows the individuals with security clearance to invoke "Executive Privilege" if asked to testify on a topic that contains classified information in which the people listening do not all have security clearance.
Section III: Declassification or changing levels
Allows the President or Founder to declassify any information they wish or lower the classification,
Any information that is not in any of these levels of classifications is known as being "unconfidential" information. The president must announce the classifications and declassifications in the Cabinet.
Section IV: Severability
Any portion of this bill that directly conflicts with the Constitution may be rendered null and void. However, unconstitutionality shall only apply strictly to any portions that are unconstitutional and not this entire Act where portions are found to be constitutional and not conflict.
Only declassified information will be made available to the public, under section III of the FNR Transparency Act.
