The Constitution of the Union of Soviet Republics of Chaylia

Section I. Citizenship and Rights

Article 1. Definition of Citizenship
(i). Citizenship is defined as when a person maintains an active World Assembly nation in the region of Chaylia that is endorsing the People’s Commissariat
(ii). The People’s Commissariat has the power to create a list of nations which are granted citizenship without the requirement of being in the World Assembly under Article 1(i)
Article 2. Right to Personal Opinion
(i). All residents and citizens of Chaylia have the right to express their opinion on any matter, but are liable for the consequences of the expression thereof.
Article 3. Right of Assembly and Organization
(i). All Citizens of Chaylia reserve the full right to organize among themselves for any matter
(ii). All Citizens of Chaylia reserve the full right to assembly among themselves
Article 4. Right to Vote
(i). Every Citizen of Chaylia reserves the right to vote for all elected members of the Chaylian Government
Article 5. Right to Petition
(i). Every Citizen of Chaylia reserves the right to petition the Council of Soviets in regional matters
(ii) Every Citizen of Chaylia reserves the right to petition the People’s Commissariat in regional matters
(iii) If a petition is denied by the People’s Commissariat and the Council of Soviets and it has garnered a majority of the citizen’s signatures then it must be brought to vote in a referendum

Section II. The Council of People’s Commissars

Article 1. People's Commissariat
(i). The People’s Commissariat is the Head of State of the Union of Soviet Republics of Chaylia
(ii). The People’s Commissariat must be elected by a majority of citizens who voted
(iii). The People’s Commissariat will serve in terms of three months
(iv). Should the People’s Commissariat be unable to serve in their office, the Council of Ministers must assume their duties until a special election can be held.
(v). The People’s Commissariat must maintain the World Assembly Delegate position in the region, barring exigent circumstances
(vi). The People’s Commissariat may create Executive Orders which hold the full weight of a law but must not contradict any already established laws
(vii). The People’s Commissariat must either sign or veto all bills presented to them by the Chair of the Presidium of the Council of Soviets
Article 2. Council of Ministers
(i). The Council of Ministers will be appointed by the People’s Commissariat with approval from the Council of Soviets
(ii). The Council of Ministers must maintain a minister for each of the Ministries as determined in further law

Section III. The Council of Soviets

Article 1. Chair of the Presidium of the Council of Soviets
(i). The Chair of the Presidium of the Council of Soviets must be elected by a majority of Deputies of the Council of Soviets
(ii) The Chair of the Presidium of the Council of Soviets will serve in terms of one month
(iii). The Chair of the Presidium of the Council of Soviets may convene and dismiss the Council of Soviets for emergency meetings
(iv). The Chair of the Presidium of the Council of Soviets must send all laws which pass the Council of Soviets to the People’s Commissariat
Article 2. Deputies of the Council of Soviets
(i) The Council of Soviets must maintain a membership of at least three elected Deputies
(ii) The Council of Soviets has the power to create and repeal laws
(iii) The Council of Soviets has the power to repeal Executive Orders
(iv) The Deputies of the Council of Soviets will serve in terms of one month

Section IV. The People’s Court

Article 1. The Procurator of the People’s Court
(i) The Procurator of the People’s Court must be the head of the People’s Court
(ii) The Procurator of the People’s Court must be elected as an independent unaligned with any political party
(iii) The Procurator of the People’s Court shall serve for terms of six months
Article 2. The People’s Court
(i) The People’s Court must be the sole organ of government with authority of the commencement, trial, action, or proceeding; criminal or civil, in the Union of Soviet Republics
(ii) All disputes surrounding any regional functions that cannot be resolved without outside meditation shall be the exclusive domain of the People’s Court
(iii) Through the power of dispute resolution, the People’s Court of Justice may, as a result of process, create common law; this power shall not be extended to create common law in lieu of statutory law established by the Union of Soviet Republics

Section V. Miscellaneous

Article 1. Supremacy of Constitution
(i). This Constitution will always hold supremacy and no Laws nor Executive Orders will contradict anything stated within the Constitution
Article 2. Supremacy of Off-Site Administration
(i). The discord server must be the only server used for official matters of government
Article 3. Amendments
(i). This document may be amended by a two thirds vote within the Council of Soviets and signed by the People’s Commissariat
(ii). This document may be amended by a referendum of two thirds vote of all voting citizens
(iii). This document may be amended or repealed in a Constitutional Convention called by either a two thirds referendum or by a two thirds vote of the Council of Soviets
