REGIONAL COUNCIL RESOLUTION


Regional Council Resolution #3
The Archonate Act

Preamble/Statement of Policy

Noting that a democratic system in a NationStates region functions the best during periods of great activity,

Recognising that the possibility of activity decreasing cannot be ignored,

Further recognising that a system that would allow the executive to be more adaptable to the state of the region would be quite beneficial for it,

Hereby;

Section I


Part IV of the Constitution is hereby fully repealed.

Section II


Part III of the Constitution is hereby amended to the following: Article VIII
Establishment and Secession

§18. The Region's executive powers shall be vested in the Archonate.

§19. The Region’s judicial powers shall be vested in the Adepti.

a. The two permanent Archons shall permanently hold Adeptus status.

a. The Archonate shall consist of a minimum of two Archons and a maximum of seven Archons.

b. Every Archon shall have its element.

c. The elements are: Anemo, Cryo, Electro, Dendro, Geo, Hydro, Pyro

§20. The Archonate shall be divided into two groups of Archons; permanent Archons, and temporary Archons.

a. The permanent Archons shall be the Anemo, and Electro Archons

b. The first Anemo Archon shall be Londoniopol.

c. The first Electro Archon shall be San Pera.

§21. The five temporary Archons shall be elected by the citizens of the region for a term of four months.

§22. Upon the resignation or removal, of a temporary Archon from the Archonate, a special election shall be held for the seat.

§23. Upon the resignation or removal of a permanent Archon from the Archonate, the Archonate shall elect amongst themselves or any citizen in good standing who has served at least two terms as a temporary Archon and has not been convicted of an offence by the Adepti an individual that shall fill in the seat as a Permanent Archon.

  1. For an individual to be elevated to the seat, it needs the assent of 2/3rds of the Archonate.

§24. The Archonate may at times, create additional seats, or choose not to hold an election for an empty seat.

  1. The creation of a seat requires the assent of 1/2 of the Archonate.

  2. The removal of a seat requires the assent of 2/3rds of the Archonate.

  3. A seat can only be removed at the end of the term of the Archon that the seat belongs to.

Article IX
Veto Powers of the Archonate
§25. No act passed by the Qixing may become law without the Archonate's assent.

§26. The Archonate may withhold its assent on any act passed by the Qixing, in which case the act shall be null and of no force.

a. The Qixing may overrule the Archonate’s decision with a 2/3rds majority vote within the Council.

§27. The Archonate may, within 90 days of withholding assent, return on that decision and grant assent to an act of the Qixing.

§28. Acts of the Qixing shall enter into force immediately upon the Archonate's assent.

Article X
Executive Decrees
§29. The Archonate may at any time issue decrees, which shall carry the force of law insofar as they do not enter in contradiction with acts of the Qixing to which the Archons gave assent, or to this Constitution.

§30. The Archonate shall be the sole institution able to amend or repeal previous decrees.

Article XI
Appointment Powers
§31. The Archons shall be the sole and final authorities capable of granting and revoking citizenship and legislator status.

§32. The Archonate shall be the sole and final authority capable of elevating a citizen to the rank of an Allogene or demoting an Allogene.

§33. The Archonate shall be the sole and final authority capable of appointing or dismissing citizens to any position in the Region.

§34. In the spirit of the above article, the Archons may create and dissolve any position in the Region except for those outlined by this Constitution, and delegate them any powers and responsibilities the Constitution affords the Archons.

§35. Delegation of powers by the Archons shall not preclude the Archons from exercising their powers.

Article XII
Judicial and Moderative Powers

§36. The Adepti may pre-emptively declare non-residents of Atlanticana as personae non-gratae, forbidding them from residing in Atlanticana. Attempts to circumvent this shall be sanctioned with deportation from Atlanticanan territory.

§37. The Adepti may remove an individual's persona non grata status, lift any sanctions placed on them, or commute any sentence they may have received.

§38. The Adepti shall maintain a list of non-residents that have been declared as personae non-gratae.

Section III


Part V is hereby amended to the following:
PART IV: THE REGIONAL COUNCIL
Article XIV
Establishment of the Regional Council
§39. The legislative powers of government shall be vested in a Qixing.

§40. The Qixing consists of every sitting Legislator.

§41. The Qixing shall meet at its on-site headquarters.

Article XV
Powers of the Qixing
§42. The Qixing has the authority to pass resolutions and constitutional amendments, and ratify treaties.

    A resolution requires a simple majority to pass, after which it shall be submitted to the Archonate for assent.

§43. Constitutional amendments and treaties require a 2/3rds majority each.

§44. The Qixing may petition the Archonate to use or refrain from using their powers for a certain action. Such petitions shall be non-binding.

§45. The Qixing may establish additional procedures on its internal functioning.

Article XVI
The Tianquan
§46. Every two months the Regional Council shall assemble and elect from among their ranks a Tianquan.

§47. Any Legislator may become the Tianquan.

§48. The Tianquan shall preside the Qixing, hold its votes, administer it, and present the acts that pass within it to the Archonate for assent.

§49. The Tianquan shall serve for a two-month term, indefinitely renewable.

§50. The Tianquan may appoint a Legislator as their Deputy Tianquan, to second them in their tasks and replace them when necessary.

§51. Before a resolution can be placed on the docket, it requires the approval of at least two Legislators.
