The Constitution of the International Republican Union

Preamble

We, the sovereign nations of the IRU, in order to exemplify the ideal republic, uphold the rule of law, increase regional activity, achieve prosperity, gain renown within the interregional community, and close the ideological gap for our benefit and that of our neighbors, do institute this Third Constitution for the International Republican Union.

Glossary

bill: A legislative proposal, repeal, or recall in the process of being submitted to and passed by Congress and signed into law by the President.

inactivity: The state of either not having logged into NationStates in three days or not having taken any kind of action in six days.

member nation: A NationStates player whose main nation and puppets are jointly classified as one member of the International Republican Union, entitled to the rights listed within the Charter of Liberties and bound by the law.

office: A named government position endowed with powers by this Constitution, with the exceptions of "member nation" and "WA Delegate."

official: A member nation who holds an office in the International Republican Union.

recall: The process in which any official, except for the Founder, may be removed from office before their term has ended.

repeal: The process in which a law or executive action is reversed and rendered void.

Article I - Legislative

Section 1:

Legislative power shall be vested in the Congress of the International Republican Union.

Section 2:

    1. Congress shall be composed of all the member nations of the International Republican Union, with the sole exception of the President.
    2. The outcome of any vote shall be determined by the sum of the votes cast by members of Congress.
    3. Congress may appoint a Speaker to be granted authority over communications and polls. No nation who has not been a member nation for one month or holds another office may be Speaker. The Speaker shall be elected to two month terms. No Speaker may serve more than three consecutive terms.
    4. Congress shall have the sole power to vote upon bills.

Section 3:

    1. Any member nation, including the President, may submit a bill for Congress to vote upon, provided they have approval from another member nation with authority over polls. A bill may comprise any legislation that does not contradict the Constitution, a repeal of existing legislation, or a motion to recall any official, except for the Founder.
    2. Every bill, with the exception of a motion to recall the President, which shall have passed Congress by simple majority vote shall, before it may become law, be presented to the President of the International Republican Union, who may sign it into law or veto it. Congress may overturn a veto by two-thirds majority vote. If the President neither signs nor vetoes the bill within seven days of its passage, it shall become law.
    3. If any official, except for the President and the Founder, remains in a state of inactivity for at least seven days, a recall for their office shall automatically be brought to poll.

Section 4:

No nation shall enter the International Republican Union into any treaty, alliance, or confederation without the consent of Congress.

Article II - Executive

Section 1:

    1. Executive power shall be vested in the President of the International Republican Union.
    2. No nation who has not been a member nation for three months or holds another office may be elected President. The President shall be elected to two month terms. No President may serve more than two consecutive terms.
    3. In case of the removal of the President from office, or of their deletion, resignation, or inactivity, the following line of succession - Secretary of Military Affairs, Secretary of Internal Affairs, Secretary of Foreign Affairs, Attorney General, Speaker, Founder - shall be followed such that the first of these willing and able to be Acting President shall be so until activity is restored or a new President takes office.
    4. If the President remains in a state of inactivity for at least fourteen days, a recall for the office of President shall automatically be brought to poll.
    5. In the event any official, except for the President, is recalled, the President shall appoint a replacement, provided that replacement is not the recalled official.
    6. In the event the President is recalled, the Acting President shall inhabit the office, irrespective of how long they have been a member nation, provided they first resign from their previous office.

Section 2:

    1. The President shall appoint a Cabinet composed of a Secretary of Military Affairs, Secretary of Internal Affairs, Secretary of Foreign Affairs, and Attorney General, so long as these Cabinet members are not already committed to an office, and may recall them at any time. The President shall be granted authority over appearance, border control, communications, embassies, and polls.
    2. The President shall be Commander in Chief of the International Republican Union Armed Forces, and shall have power to grant pardons for offenses against the International Republican Union, except for their own.
    3. The President shall have the power to declare a state of emergency, in which instance the Founder shall be granted the full use of the President's powers.

Section 3:

The Secretary of Military Affairs shall be granted authority over border control and communications, and shall advise the President on matters of military policy.

Section 4:

The Secretary of Internal Affairs shall be granted authority over appearance and communications, and shall advise the President on matters of internal policy.

Section 5:

The Secretary of Foreign Affairs shall be granted authority over communications and embassies, and shall advise the President on matters of foreign policy.

Section 6:

The Attorney General shall be granted authority over communications and polls, and shall serve as the chief lawyer and prosecutor of the International Republican Union.

Section 7:

The President and their Cabinet shall recite the following oath upon taking office: "I, [name of nation], do solemnly swear that I will faithfully execute the office of [name of office] of the International Republican Union, and will, to the best of my ability, preserve, protect, and defend the Constitution of the International Republican Union."

Section 8:

The President may choose a WA Delegate to represent the will of the International Republican Union in the World Assembly.

Section 9:

The Founder shall grant authority to all offices that possess it. The Founder shall be unable to run for office, but may, at their discretion, fill in for any officials in a state of inactivity.

Article III - Judicial

Section 1:

Judicial power shall be vested in the Supreme Court, composed of the Secretary of Military Affairs, Secretary of Internal Affairs, and Secretary of Foreign Affairs, and in such lesser courts as Congress may establish.

Section 2:

The Supreme Court shall have original jurisdiction in all cases affecting foreign ambassadors and in which the government of the International Republican Union, represented by the Attorney General, is a party. The Supreme Court shall have appellate jurisdiction for any other cases, provided a lesser court exists.

Section 3:

The trial of all crimes shall be by jury.

Article IV - Member Nations

Section 1:

The President shall make any nation who has resided in the International Republican Union or its territories for seven days without inactivity a member nation at the nation's request, provided they are not already a member nation.

Section 2:

The member nations of the International Republican Union shall be entitled to full autonomy in self governance.

Section 3:

The International Republican Union shall guarantee residency and a republican form of government to every member nation, and shall protect each of them against invasion.

Article V - Amendment

Section 1:

Congress may pass an amendment to the Constitution provided two of the following shall have been achieved:

    - The simple majority vote of Congress.
    - The President's approval.
    - The Founder's unambiguous declaration of approval on the Regional Message Board.

Section 2:

Congress may repeal the Constitution provided all of the following shall have been achieved:

    - The simple majority vote of Congress.
    - The President's approval.
    - The Founder's unambiguous declaration of approval on the Regional Message Board.

Article VI - Law

Section 1:

All treaties signed and alliances entered by the International Republican Union and its territories before the adoption of this Constitution remain valid, unless the terms therein infringe upon the rights granted by this Constitution.

Section 2:

This Constitution, the laws of the International Republican Union which shall be made in pursuance thereof, and all treaties made under the authority of the International Republican Union, shall be the supreme law of the land.

Article VII - Ratification

Section 1:

A simple majority of all invited participants of the Constitutional Convention shall sign the Constitution into law in order for it to be ratified.

Section 2:

Invited participants of the Constitutional Convention may sign the Constitution for up to three days after ratification. Entire regions wishing to be bound by International Republican Union law may sign at any time.

Section 3:

All invited participants of the Constitutional Convention who have signed the constitution will be counted as member nations eligible for every office.

Charter of Liberties

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech or of the press, or the right of member nations to assemble peaceably and to petition the government for a redress of grievances.

The right of member nations to join and leave the World Assembly shall not be infringed.

No member nations shall be subject to be punished twice for the same offense, nor compelled in any criminal case to bear witness against themselves, nor banned from the International Republican Union without due process of law.

In all criminal cases, the accused shall enjoy the right to a speedy, fair, and public trial by jury, be informed of the nature and cause of the accusation, be confronted with the witnesses against them, and have the assistance of a defense attorney of their choosing.

The enumeration of certain rights in this Constitution shall not be construed to deny or disparage others retained by member nations.

The powers not delegated to the International Republican Union by the Constitution, nor prohibited by it to its territories or member nations, are reserved to the territories and member nations respectively.

The right of member nations to vote shall not be denied or abridged by the International Republican Union or by any member nation on any count. Congress shall have power to enforce this with appropriate legislation.
