Preface

Hello and welcome!

Whether you are just a visitor stumbling by, looking at this little piece of legislative history, or a Citizen of the New Western Empire looking to familiarize yourself with the law, or perhaps preparing to file a case in the Imperial Courts, you are currently looking at a piece of history. This text, currently in circulation for some 5 years, shaped the legal destiny of the New Western Empire and its predecessor, the New Western Atlantic. It has gone a long way, through agreement and conflict, from the original, with numerous amendments, fixes, expansions, and redefinitions, yet the core content is the same, surviving the harsh test of time.

The Constitution of the New Western Empire is innovative, unique in the context of NationStates. It guarantees a safe democracy, safeguarded by the limited constitutional monarchy of the Emperor, the guarantor of stability within the Empire. This formula has proven extremely successful, with the Region never experiencing a total, destructive collapse, unlike many other regions within the greater family tree of the spin-offs and sister regions that sadly didn't make it. It is the duty of the future generations of Imperial Citizens to maintain, safeguard, and constantly refine the Constitution, as it was done for the entire history of the region.

A history of ups and downs. Rises and falls. We should remember the transition from the Atlantic to the Empire. We should remember everyone who has ever set foot in our land, which we believe stands for liberty and prosperity, for their spirit lives on in this file. It's a statement that many of the edgier parts of our society will reject, yet, I hope that the majority of the readers here will realize the importance of memory and the fact that nothing in the Empire is ever truly lost.

When reading this document, one must remember that it is not just a bunch of useless words. It is a legacy of everyone who has ever contributed to the Empire and the Community for which it stands. If we are lucky and diligent, this legacy shall last a thousand years more. I would like to make an honorary mention of the single largest contributor to the legal history of the Empire - TnP. I would like to commend any and all people who have ever contributed to the legal system, whether in the Court or in the Legislature. This is a testament to their commitment. I hope that the visual part of the Dispatch I have prepared is pleasing for the eye and I hope that you enjoy your stay in the Empire.

Imperial Constitution of the New Western Empire

Preamble

Under pressure to revitalize the New Western Empire, to meet and exceed past standards of governance, this Imperial Constitution is established to restore trust in the Empire and to represent the future direction of the region. For, The New Western Empire has once again been given the chance to redefine itself and prove to the world that it will endure. Thus, this Imperial Constitution, both in its current and future states, will represent what the Empire has worked to establish for others to follow.
Article I - Citizenship, Nobility, Status of Foreign Diplomats


Section I - Requirements for Citizenship
  • Any nation that has resided within the New Western Empire for a period of one week or longer, that is also a member of the World Assembly, may be granted citizenship.

  • An exemption to the World Assembly membership requirements may be made by the Emperor if the nation in question makes an appeal to them.

  • Citizens must report all puppet nations to either the Emperor or the Imperial Chancellor of the New Western Empire

Section II - Residency

  • Nations who reside within the New Western Empire, but are not citizens, are residents.

  • Puppet nations of a resident or citizen of the New Western Empire are not considered residents themselves. Puppets, if their name does not make it plainly obvious as to their nature, must be reported to the Emperor.

Section III - Nobility

  • Citizens may be granted noble titles through nomination by the Emperor and confirmation through a simple majority vote of the Imperial Diet.

  • Titles of nobility are organized within a hierarchy with Endowed Peerages above Subsidiary Peerages

    • Endowed Peers shall be ranked from highest to lowest as: Prince, Duke, and Count.

    • Subsidiary Peers shall be ranked from highest to lowest as: Viscount, Earl, Baron, and Lord.

  • The Emperor may elevate or degrade a noble's rank with the consent of the Imperial Diet.

  • Titles may be altered to their feminine equivalent should it be requested by the recipient.

  • Nobles may only hold a single title at one time with the exception of extraordinary titles.

    • Extraordinary Titles being defined as the title of Emperor and any other titles that are not peerages

Article II - Executive, Legislative, and Judiciary Branches


Section I - The Executive
  • The Executive Branch of the New Western Empire shall be led by the Imperial Chancellor.

  • The Imperial Chancellor shall be elected by the Imperial Diet.

      Once every three months the Imperial Chancellor must be reconfirmed by the Imperial Diet or resign.
      If the Imperial Chancellor resigns before the end of their three month term, then the Imperial Diet shall be required to appoint a successor for a new three month term.

  • The Imperial Chancellor shall select a Prefect of Foreign Affairs and a Prefect of the Interior. They shall be tasked with handling foreign and internal affairs respective of their office.

    • The Prefects must be citizens.

    • The Imperial Chancellor may create new prefectures to be run by Prefects as they see fit.

    • Prefects may select a citizen to be their deputy.

    • Deputies of a Prefect shall assist their respective Prefect in matters pertaining to their prefecture.

  • The Imperial Chancellor shall be the Head of Government of the New Western Empire.

  • The Imperial Chancellor is responsible for archiving the actions of the Imperial Diet such as, but not limited to: Passed Legislation, Failed Legislation, an Overview of the Imperial Diet, and Voting Records.

    • These Archives must be made available to the public.

    • The Imperial Chancellor shall be allowed to appoint an individual as Keeper of the Seal to assist with their record keeping duties

Section II - The Imperial Diet

  • The singular authority permitted to pass, amend, and revoke legislation shall be the Imperial Diet, the Legislative Branch of the New Western Empire.

    • All proposed legislation must first allow a debate period in which peers may ask questions or debate the proposed legislation. This period shall last between twenty four to seventy two hours at the Imperial Chancellor’s discretion.

    • After the debate period has ended, proposed legislation shall enter a voting period which shall last twenty four hours. During this period voting peers shall be able to vote ‘Aye,’ ‘Nay,’ and ‘Abstain.’

    • For legislation to pass it must have a simple majority of ‘Aye’ votes.

    • Amendments to the Imperial Constitution of the New Western Empire must have more than two thirds approval by the Imperial Diet.

    • During votes on amendments to the Imperial Constitution of the New Western Empire, ‘Abstain’ votes shall not be permitted.

  • The Imperial Diet shall be made up of Endowed Peers, excluding The Emperor.

  • The Imperial Diet shall elect one of its members as Imperial Chancellor.

  • The Imperial Diet is the sole body with the authority to amend the Imperial Constitution of the New Western Empire.

  • The Imperial Diet shall be responsible for overseeing votes of no confidence to remove holders of Public Offices.

Section III - The Imperial Court

  • The Imperial Court shall be the Supreme Court and Judicial Branch of the New Western Empire.

  • The Imperial Court shall be made up of two Justices and one Chief Justice.

    • The two Justices and the singular Chief Justice shall be appointed by The Emperor and confirmed by a simple majority vote in the Imperial Diet.

    • The Justices and Chief Justice of the Imperial High Court shall serve indefinitely or until their resignation or removal.

  • The Imperial Court shall have the authority to issue a judicial review of all passed and proposed legislation to ensure its compliance with the Constitution of the New Western Empire.

  • The Imperial Court reserves the right to determine its own court rules and filing standards.

  • The Imperial Court shall have the ability to provide Imperial Constitutional interpretations upon request.

  • The Imperial Court shall provide judgement and determine punishment during court cases involving an alleged violation of the law.

Section IV - The Emperor

  • The Emperor shall be the Head of Nobility, the Head of State, and the Electoral Commissioner.

  • The Emperor shall be the Head of Moderation of the New Western Empire regional discord server, and shall reserve the right to appoint Server Custodians.

  • The Emperor must be a noble and endowed peer, as the title of emperor is extraordinary and beyond all others.

  • The Emperor may veto one constitutional amendment per general election cycle, however, the Imperial Court may overrule the veto if it is believed to be necessary.

  • The Emperor may grant noble titles to citizens with the consent of the Imperial Diet through a simple majority vote

  • The Emperor may be removed and a new one elected if three fifths of the Imperial Diet chooses to do such.

Section V - Succession

  • If an individual who holds a Public Office resigns, they shall be succeeded by their deputy if they had one, and if said deputy had been in the position for at least seven days.

    • If no viable deputy exists then the former office holder shall have to be replaced via a snap election or through an appointment depending on the method in which the office holder acquires said office.

    • Ceasing to Exist shall constitute resignation unless the nation returns within twenty four hours.

Section VI - Public Office

  • All government positions are to be considered Public Offices.

  • All Public Offices within the Imperial Diet and the Executive are to be elected positions if not stated otherwise.

  • Public Offices within the Executive shall be elected every General Election, which shall occur every four months.

    • One week prior to a General Election, a candidacy period shall be held in which individuals shall submit their candidacy and deputy choice to the election commissioner, who will then announce the candidates and their deputies at the end of the candidacy period.

    • The Election Period of the General Election shall last for no more than three days. During this period voters may submit votes for their desired candidate.

  • Elections for Public Offices shall be conducted in one of two ways depending on the number of candidates running for said office.

    • If more than two candidates run for office than the election shall use a ranked choice voting system

    • If only two candidates run then a simple majority vote will decide the election.

  • To hold a Public Office one must be a citizen of the New Western Empire.

Section VII - Other Offices

  • The King of Arms shall be appointed by The Emperor with the consent of the Imperial Diet, and shall answer directly to The Emperor

    • The King of Arms shall be the head of the College of Arms and shall possess only the ability to issue and revoke grants of arms.

    • The King of Arms shall serve until their resignation.

  • The Keeper of the Seal shall be appointed by the Imperial Chancellor, and shall handle the record keeping of the Imperial Diet.

    • The Keeper of the Seal shall serve until their resignation.

    • If the position of the Keeper of the Seal is unfilled then the Imperial Chancellor shall perform the duties of the position

Article III - Rights of the Individual


Section I - Universal Rights
  • All individuals within the New Western Empire, regardless of citizenship status, shall be entitled to these inalienable rights.

    • The right to freedom of speech shall not be infringed, unless that speech violates the Terms of Service of Discord, Nationstates, or violates laws within the New Western Empire regarding hate speech and threats.

    • The right to campaign, petition, distrust, and protest against the government of the New Western Empire shall not be infringed.

    • The right to freedom of the press shall not be infringed.

    • The right to free political association shall not be infringed.

    • The right to establish, lead, organize, or leave a political party shall not be infringed.

    • The right to a fair and just trial shall not be infringed.

Section II - Citizen Exclusive Rights

  • All Citizens within the New Western Empire shall be entitled to these rights.

    • The right for citizens to endorse candidates, motions, and actions shall not be infringed.

    • The right to appeal shall not be infringed, nor shall citizens be barred from the chambers of the Imperial Court.

Section III - - Noble Privigiles

  • All Nobles within the New Western Empire shall be entitled to these rights.

    • All peers have the right to bear arms.

    • All peers have the right to appeal immediately to the Imperial Court.

    • All peers have the right to request an audience with the Imperial Diet.

    • Subsidiary Peers have the right to introduce legislation to the Imperial Diet, and to debate on proposed legislation, but not to vote on legislation.

    • Endowed Peers have the right to introduce legislation to the Imperial Diet, to debate on proposed legislation, and to vote on legislation.

Article IV - Constitutional Supremacy


Section I - Legislation
  • All legislation passed by the Imperial Diet must be in compliance with the Imperial Constitution of the New Western Empire.

  • If proposed or passed legislation violates the principles of the Imperial Constitution of the New Western Empire then it shall be rendered null and void on the basis of unconstitutionality.

  • It shall be the responsibility of the Imperial Court to assess the constitutionality of proposed and passed legislation.

Section II - Treaties

  • All treaties established by the Prefect of Foreign Affairs, in conjunction with the Imperial Diet, must conform to the Imperial Constitution and laws of the New Western Empire.

  • All treaties, past, present and future, that fail to conform to the Imperial Constitution and laws of the New Western Empire shall be rendered null and void on the basis of unconstitutionality.

  • It shall be the responsibility of the Imperial Court to determine the constitutionality of treaties with foreign powers.[/list

Article V - Transitional Provisions


Section I
  • Immediately on the ratification of This Imperial Constitution, all former Imperial Constitutions and laws passed by the offices and structures established by those Imperial Constitutions are rendered null and void, unless explicitly said otherwise.

  • The principle of official recognition of parties by the State shall be abolished and any parties previously possessing recognition shall lose it.

  • The incumbent Emperor shall maintain their office.

  • Members of the High Court shall serve as acting Judges of the Imperial Court until the composition of the Imperial Court is confirmed.

  • The Consul that is in office during the ratification and adoption of this Imperial Constitution shall reserve the right to assume an extraordinary title of their choosing. They may not change the extraordinary title once they decide on one. This extraordinary title is not a peerage.

  • The Consul shall immediately assume the role of Imperial Chancellor until the composition of the Imperial Diet is confirmed.

  • The Consul, with the assistance of members of the old nobility and non-nobility, shall determine the composition of the Imperial Diet and the individuals holding titles of peerage.

  • Once the composition of the Imperial Diet is confirmed, the Imperial Diet may elect a new Emperor if the Imperial Diet wishes to do so. Nothing shall inhibit or prevent the incumbent Emperor to run, should they so please.

  • Once the composition of the Imperial Diet is confirmed, the Imperial Diet shall appoint Judges of the Imperial Court.

  • The King of Arms shall retain their office unless the Imperial Diet explicitly objects to the contrary.

Section II

  • Section 3 (Excluding Article 3) of L.R. 3 passed by the Senate shall be immediately adopted as the Criminal Code of the Empire. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 5 in its entirety passed by the Senate shall be immediately adopted as the Law on Judicial Assurance. All mentions of “Court” shall be corrected to “the Imperial Court”. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 8 in its entirety passed by the Senate shall be immediately adopted as the Law on the Discord. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 45 in its entirety passed by the Senate shall be immediately adopted as the Law on the Starboard of the Empire. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 46 in its entirety, barring the inclusion of the term “House of Nobility”, passed by the Senate shall be immediately adopted as the Law on the College of Arms. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

    • The right to campaign, petition, distrust, and protest against the government of the New Western Empire shall not be infringed.

    • The right to freedom of the press shall not be infringed.

    • The right to free political association shall not be infringed.

    • The right to establish, lead, organize, or leave a political party shall not be infringed.

    • The right to a fair and just trial shall not be infringed.

Section II - Citizen Exclusive Rights

  • All Citizens within the New Western Empire shall be entitled to these rights.

    • The right for citizens to endorse candidates, motions, and actions shall not be infringed.

    • The right to appeal shall not be infringed, nor shall citizens be barred from the chambers of the Imperial Court.

Section III - - Noble Privigiles

  • All Nobles within the New Western Empire shall be entitled to these rights.

    • All peers have the right to bear arms.

    • All peers have the right to appeal immediately to the Imperial Court.

    • All peers have the right to request an audience with the Imperial Diet.

    • Subsidiary Peers have the right to introduce legislation to the Imperial Diet, and to debate on proposed legislation, but not to vote on legislation.

    • Endowed Peers have the right to introduce legislation to the Imperial Diet, to debate on proposed legislation, and to vote on legislation.

Article IV - Constitutional Supremacy


Section I - Legislation
  • All legislation passed by the Imperial Diet must be in compliance with the Imperial Constitution of the New Western Empire.

  • If proposed or passed legislation violates the principles of the Imperial Constitution of the New Western Empire then it shall be rendered null and void on the basis of unconstitutionality.

  • It shall be the responsibility of the Imperial Court to assess the constitutionality of proposed and passed legislation.

Section II - Treaties

  • All treaties established by the Prefect of Foreign Affairs, in conjunction with the Imperial Diet, must conform to the Imperial Constitution and laws of the New Western Empire.

  • All treaties, past, present and future, that fail to conform to the Imperial Constitution and laws of the New Western Empire shall be rendered null and void on the basis of unconstitutionality.

  • It shall be the responsibility of the Imperial Court to determine the constitutionality of treaties with foreign powers.[/list

Article V - Transitional Provisions


Section I
  • Immediately on the ratification of This Imperial Constitution, all former Imperial Constitutions and laws passed by the offices and structures established by those Imperial Constitutions are rendered null and void, unless explicitly said otherwise.

  • The principle of official recognition of parties by the State shall be abolished and any parties previously possessing recognition shall lose it.

  • The incumbent Emperor shall maintain their office.

  • Members of the High Court shall serve as acting Judges of the Imperial Court until the composition of the Imperial Court is confirmed.

  • The Consul that is in office during the ratification and adoption of this Imperial Constitution shall reserve the right to assume an extraordinary title of their choosing. They may not change the extraordinary title once they decide on one. This extraordinary title is not a peerage.

  • The Consul shall immediately assume the role of Imperial Chancellor until the composition of the Imperial Diet is confirmed.

  • The Consul, with the assistance of members of the old nobility and non-nobility, shall determine the composition of the Imperial Diet and the individuals holding titles of peerage.

  • Once the composition of the Imperial Diet is confirmed, the Imperial Diet may elect a new Emperor if the Imperial Diet wishes to do so. Nothing shall inhibit or prevent the incumbent Emperor to run, should they so please.

  • Once the composition of the Imperial Diet is confirmed, the Imperial Diet shall appoint Judges of the Imperial Court.

  • The King of Arms shall retain their office unless the Imperial Diet explicitly objects to the contrary.

Section II

  • Section 3 (Excluding Article 3) of L.R. 3 passed by the Senate shall be immediately adopted as the Criminal Code of the Empire. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 5 in its entirety passed by the Senate shall be immediately adopted as the Law on Judicial Assurance. All mentions of “Court” shall be corrected to “the Imperial Court”. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 8 in its entirety passed by the Senate shall be immediately adopted as the Law on the Discord. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 45 in its entirety passed by the Senate shall be immediately adopted as the Law on the Starboard of the Empire. It shall have the status as a piece of legislation under the authority of the Imperial Diet.

  • L.R. 46 in its entirety, barring the inclusion of the term “House of Nobility”, passed by the Senate shall be immediately adopted as the Law on the College of Arms. It shall have the status as a piece of legislation under the authority of the Imperial Diet.
