Difficult question! I love a croissant and a well-fired roll. But there were these delicious apple/custard pastries I got on holiday one time and I can’t remember what they were called :|
I notice the current WA proposal is garnering quite a lot of votes, but there are many aspects of it that I am concerned about. It is overall a necessary piece of legislation, but when it comes to the specifics there are some things which detract from it, namely;
* Introductory clause 2 - this is a bit random and out-of-place, since the actual provisions are about disability exclusively. But, I would be prepared to let that slide if only the problems listed below were not also present.
* The definition - what does ‘within their own or their doctor’s jurisdiction’ mean? Does that essentially mean anyone can identify as disabled and be entitled to the provisions of the resolution? Identification of disability resting with medical professionals would be better IMO
* Clause 2d - what about detainment where they are a risk of harm to themselves? This is not permitted under the current wording.
* 4 - I feel like this needs to be more nuanced. Discrimination can be necessary, eg where the disability is disqualifying for a physical role. Would have preferred this to be closer to 2b, which says qualified disabled applicants for jobs can’t receive worse terms of employment. UK equality law requires “reasonable adjustments” to accommodate disabled persons - this approach would be much more helpful rather than denying the reality that many disabled people are sadly unable to serve as a firefighter eg
Not sure it solves the problems it sets out to either. Eg introductory clause one talks about the need for infrastructure to help the disabled, but that is not really what the res actually does
1) With the "doctor's jurisdiction" part, by jurisdiction it seems they mean a sort of judgement or decision. It says "in one's own, a guardian's, or a doctor's jurisdiction", so based on what is seen or felt, it us decided an individual has a disability.
2) As far as Clause 2d goes, it does say "refrain", rather than "mandate" or so on. Basically, this is meant to discourage detainment unless absolutely necessary, as is the case in possibility of self-harm.
3) I feel like Article 4 is fine, since it seems to reference how the disabled are treated as a whole in society. In a job situation, you're not necessarily discriminating against a physically disabled person if you don't pick them for a physically taxing position. They may be disqualified because of what the job requires, but not discriminated. Discrimination has to do more with prejudice and hate, and overall how you don't respect someone else's dignity because of certain traits they may have. It doesn't have to reflect in saying yes or no based on capability.

I still don't think it should be within one's own jurisdiction to decide, but since it only affects the provisions of this resolution and not domestic legal definitions it's fine, I guess. You have persuaded me on 2d. As for article 4, I am prepared to go with that interpretation of 'discrimination', even though I understand the word more broadly. I think the resolution intends that we go with your interpretation :-)
