The Courts need to prioritise truth over privacy, and if the journal contains relevant informations on the matter which is judged, it should definetly be taken into account, especially in important cases such as murder, rape, theft, corruption etc.

I wouldn't feel comfortable if my journal was used as evidence against me, I know I would feel that only i have the right to read it or share it with other people. Anyways you cant tell if a diary has relavent information unless you read it, which is a breach of personal privacy especially if it turns out that it has no relavent information in it. Plus searching houses of all suspects and others would cost a lot of money and theres no way to know whether the diary entries are authentic or fabricated, which could lead to injustice.
